Prize Drawing Rules
NO PURCHASE NECESSARY TO ENTER OR TO WIN. MUST BE AN ACTIVE MEMBER OF ARA OR PBA AS OF 12/31/2023. MUST BE PRESENT TO WIN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. WINNERS ARE REQUIRED TO PAY ALL TAXES ON PRIZES THEY WIN, INCLUDING SALES TAX. VOID WHERE PROHIBITED. THE ODDS OF WINNING DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED PRIOR TO DRAWINGS. OFFICIAL ARA & PBA SWEEPSTAKES RULES
1. ELIGIBILITY. Subject to the additional restrictions below, ARA & PBA (collectively “ARA”) sweepstakes is open to: (i) current ARA members in good standing as of December 31, 2023. (ii) ARA stores must have completed 2023 Recertification; (iii) who are 18 years or older at the time of entry and who have either (a) a valid driver’s license or state-issued ID; and (iv) ARA Employees, Board of Directors and Vendors are not eligible to enter or win prizes. Participation constitutes the entrant’s full and unconditional agreement to these Official Rules.

2. LIMIT. Except for the Grand Prize, only one (1) other prize per individual Primary Member, regardless of the number of eligible entries submitted by the member. If any member of your household wins any prize, except the Grand Prize, the other member of your household is eligible to win and receive additional prizes in this Sweepstakes, as long as the winner is also a Primary Member of ARA or PBA and meets all the eligibility criteria and rules.

3. HOW TO ENTER. Each eligible ARA and BPA Primary Member will receive one entry ticket for the Grand Prize and one for all other prizes given away at the event per member store. The deadline to enter for the Grand Prize drawing is 3:00 pm on the day of the event. The tradeshow starts at 11:00 am and ends at 5:00 pm on Wednesday, February 21st, 2024. All prizes will be drawn during the show hours. An announcement will be made 10 minutes before the drawing. You must be present to win. If the winning entrant is not present, the entries will be redrawn until the prize is awarded to an entrant present during the drawing.

4. DRAWING AND ODDS OF WINNING. Winners will be selected randomly from all eligible entries received prior to the drawing time. A designated Sweepstakes Administrator will conduct the drawing. The Sweepstakes Administrator’s decisions as to the operation of the Sweepstakes drawings are final and binding in all matters related to the Sweepstakes. The Sweepstakes Administrator will conduct the drawing and randomly select the potential Sweepstakes winners from all eligible entries received during the applicable drawing. Each winner is considered a potential winner pending eligibility verification and compliance with the Official Rules. The odds of winning depend on the number of eligible entries received.

5. SWEEPSTAKES PRIZES:
1. Grand Prize, Audi A4, valued at approximately $40,000.
2. (1) Samsung Galaxy S24 Ultra, valued at approximately $1,900.
3. (2) Vacation package valued at approximately $1,500 each.
4. (4) iPad Pro 11 valued at approximately $800 each.
5. (6) Samsung 85’ Class Q60C QLED TV valued at approximately $1300 each.
6. (8) Gift Cards are charged at $500 each.

6. ALL PRIZES. All prizes are non-transferable; no cash redemption or prize substitution is permitted. ARA reserves the right to substitute a prize for one of equal or greater value should the designated prize become unavailable for any reason.

7. NO WARRANTY. The prizes carry no warranty other than what is offered by the manufacturer. ARA has neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the prize, including but not limited to its quality, mechanical conditions, or fitness for a particular purpose. The winner agrees to look solely to the manufacturer for any such warranty, representation, or guarantee.

8. PAYMENT OF TAXES. The winner is solely responsible for all federal, state, local, or other applicable taxes, including Georgia Sales Tax associated with the acceptance and use of the prize. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winner.

9. PUBLICITY AND MARKETING. BY SUBMITTING AN ENTRY, THE ENTRANT ACKNOWLEDGES THAT HIS/HER ENTRY CONTENT AND/OR PHOTO/VIDEO MAY BE POSTED ACROSS ANY OR ALL OF ARA'S DIGITAL, PRINT, AND SOCIAL MEDIA ASSETS AT THE ARA’S SOLE DISCRETION AT ANY TIME. By entering the Sweepstakes, the entrant grants ARA and its agents the royalty-free, non-exclusive, and sublicensable right and license to use, distribute, reproduce, modify, adapt, translate, publicly perform, and publicly display the entrant’s content and/or photo and video.

10. LIMITATION OF LIABILITY AND RELEASE. No liability or responsibility is assumed by ARA and Sweepstakes Representative (collectively, “Releasees”) resulting from any individual’s participation in or attempt to participate in the Sweepstakes. No responsibility or liability is assumed by Releasees for technical problems or technical malfunction, including, without limitation, those arising in connection with any of the following occurrences that may affect the operation of the sweepstakes: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; (i) lost, late, incomplete, illegible, indiscernible, or misdirected Entries or for any typographical errors in the announcement of the prize or these Official Rules, (ii) any inaccurate or incorrect data contained on promotional materials or on the ARA’s website, or (iii) any error in the administration of the sweepstakes announcement of the prize and/or all sweepstakes-related materials. Releasees are not responsible for any personal injury or property damage or any other losses of any kind that may be sustained resulting from participation in the sweepstakes or receipt or use of the prize. As a condition of entering, entrants agree (and agree to confirm in writing if requested by ARA: (a) to forever discharge, release, and hold harmless Releasees from any and all claims, liabilities, injuries, losses, damages, causes of action, suits, and demands of any kind arising from or in connection with the sweepstakes or the prize, however caused; (b) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental, indirect, special, exemplary, consequential, or any other damages; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorney’s fees and court costs.

11. LEGAL WARNING. ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, ARA RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

12. ARA’S RESERVATION OF RIGHTS. If the Trade Show and/or the Sweepstakes is not capable of running as planned, at the sole discretion of ARA, the event may be canceled without notice and without any further obligations on the part of ARA to conduct another Sweepstakes at any time in the future. If the Sweepstakes is canceled for any reason, including without limitation, due to force majeure or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, ARA reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process or otherwise acts in violation of these Official Rules, and to cancel, modify, or terminate the Sweepstakes. In the event of cancellation, ARA will not be obligated to award the prizes in a drawing from among all eligible, non-suspect entries received prior to cancellation. In the event that an entry is confirmed to have been erroneously deleted, lost, or destroyed, the entrant’s sole remedy shall be another entry into the Sweepstake.

13. GOVERNING LAW & JURISDICTION. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of ARA in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any choice of law or conflict of law rules. By entering, you consent to the jurisdiction and venue of the state and local courts located in Gwinnett County, Georgia and the federal courts located in the Northern District of Georgia, Atlanta Division, for the resolution of all disputes, and agree that any and all disputes shall be resolved exclusively in those courts. ARA failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
